Here you’ll find information about commissioning work, staying in touch and how your data is handled. Use the contents to go straight to the section you need.
This information concerns individually agreed garden design, planting and border design, and the online climate adaptation audit. The quote prepared for the order defines the scope of each service.
This information applies to individually commissioned services; it does not cover purchases of ready-made digital products from the webshop.
Quote and design scope
Getting in touch is the first step. A quote based on your garden and your needs sets out the task, documents to be delivered, fee and agreed deadline. Packages offer a starting point; we clarify the scope for your specific garden before you order.
Ordering and payment
An order is based on acceptance of the agreed quote. Online orders are paid in advance. For traditional garden design, payment follows an individual agreement, usually in two equal instalments. Exact payment terms are clarified before you order.
Current starting prices and individually available design services are listed on the Packages and prices page.
Site information and consultation
We agree on the photos, measurements, base plans and ideas needed for the task. I will let you know during the work if information needs clarifying or adding. You can prepare using the design process page as a guide.
Handover and changes
I deliver the completed work in the agreed form and scope. We separately clarify the revisions included in the package and any extra work arising from new requests. Building the garden and specialist tasks outside the design require separate commissions.
Questions or feedback
For questions about your order or the delivered work, email kapcsolat@frugarden.hu with the project details and what you’d like to clarify.
03 / If your plans change
Cancellation and settlement
Stopping the work
You may cancel before the work is complete. Send a clear statement to kapcsolat@frugarden.hu or the provider’s postal address. Once I receive it, I will not start any new part of the work. If work has not yet begun, I charge no cancellation fee and refund the amount paid.
Proportionate payment for completed work
If work has begun, we settle the services demonstrably completed up to that point. The settlement lists the tasks performed, materials available for handover and fee calculation. It is based on the stage fees defined in the accepted quote and each stage’s completion level. If no stage fees are specified, a verifiable calculation reflects the total agreed fee and the proportion of work done; I do not introduce an hourly rate retrospectively.
I hand over the completed, charged-for material, stating its completion level and any limits on use. An unfinished plan may not be suitable for construction on its own. I do not charge for work not yet done or a separate cancellation penalty. This settlement concession does not restrict mandatory consumer rights.
Advance payments, interim invoices and refunds
Any advance payment for an online order or instalments paid are fully credited in the settlement. Payment alone does not constitute earnest money or a non-refundable cancellation charge.
An interim invoice may be issued for a completed part that qualifies as partial performance under the contract. Amounts received before performance are covered by an advance invoice; on closure, a settlement, final or amended invoice reflects actual performance under the invoicing rules. I do not invoice the same work twice.
I refund any balance owed within 14 days of learning of the cancellation. If the fee for verified, lawfully chargeable work exceeds your payment, the difference is due by the date shown on the settlement invoice, consistent with the quote.
Consumer withdrawal and termination
As a consumer entering a distance or off-premises service contract, you may withdraw without giving a reason within 14 days of conclusion; if performance has begun, you may terminate. Sending your statement within the deadline is sufficient.
Starting work within those 14 days requires your prior express request, recorded in a durable form. Advance payment alone is not such a request. If you received proper information and requested the early start, termination requires proportionate payment for services performed up to notification. Without the legally required information or request, the cost of services begun this way cannot be charged to you.
After the full service is performed, this right ends only under the statutory conditions: prior express consent and acknowledgement of losing the right are required. The fact that a design is bespoke does not itself exclude consumer rights relating to the service.
Refunds use the original payment method unless you expressly agree otherwise; you incur no extra cost as a result. If information was incomplete, the longer statutory periods apply. These rules are based on Hungarian Government Decree 45/2014 (II. 26.).

04 / Personal data
Privacy information
Consultation and design require contact details and information about your garden. The following sections explain why I process these data.
Contact and quote requests
Data: name, email address, any phone number you provide, garden location, message content and attachments you send.
Purpose: responding to your enquiry, clarifying the task and preparing a quote. The legal basis for pre-contract discussions at your request is taking steps prior to entering into a contract.
Performing the design commission
Data: contact details, site photos, measurements, base plans, consultation records and information supplied for the design.
Purpose: providing the agreed service and handing over the completed work. The legal basis is performance of the contract.
Invoicing and related records
Data: billing name and address, tax number where needed, and invoice and performance details.
Purpose: issuing invoices and maintaining required records. The legal basis is compliance with the applicable legal obligation.
Materials you provide
Please include only information needed for design in garden photos and attachments. Do not send identity documents or personal data unrelated to garden design.
Retention periods
Enquiries that do not lead to an order
After discussions end, I keep the quote and necessary correspondence for up to 12 months so the history can be retrieved. Continued retention is based on the legitimate interest in documenting discussions; you may object. Unneeded attachments are deleted earlier.
Contract and proof of performance
I retain the contract, accepted quote, key correspondence and final delivered work for 5 years after the commission ends, based on the legitimate interest in asserting and defending contractual claims. In an ongoing dispute, relevant records may be kept until the proceedings and related claims are concluded.
Working copies and unnecessary photos
Raw photos, intermediate versions and copies not needed as proof of performance are deleted within 12 months of the commission ending. Any further use for later work is agreed within a new commission. Retention does not authorise publication as a reference project.
Invoices and tax records
Records are retained to meet legal obligations for the periods required by applicable tax rules. Under the general tax procedure rule, this lasts until the right to assess tax expires, usually 5 years from the end of the year in which the return was due or the tax payable. Different mandatory retention rules and extensions of limitation periods must be taken into account.
At the end of retention, I delete or irreversibly anonymise the data. Justified longer retention applies only to the affected data. These periods also apply to correspondence and stored attachments.
